Lecasbas 176 Posted December 26, 2008 Report Share Posted December 26, 2008 Either the Plaintiff or Defendant can file a MSJ if either feels there are no genuine issues left to debate. If, for example, Discovery has revealed that the Plaintiff does not have proper assignment then the Defendant can file a MSJ asking that the Plaintiff's claim be dismissed and that the Defendant's counterclaims be awarded.
