Hi

i am being sued by asset acceptance for an old acct. they sent me a discovery package which i answered carefully and with info gained on this site in turn i sent them a request to produce records which i asked for authentic copies of all bills and my original signed c.c. application and they are saying they do not have any of these items they said that they were destroyed. Does anyone know how i should respond to this being that they are unable to produce any documents. please help!!!!!!!!! and happy new year to all..........

If they truly have no documents than I'd consider that good news for you.

Do you know if this account (assuming it is your account) is in or out of statute?

Have they committed any FDCPA/FCRA violations that might provide you some leverage and/or a reason to sue them?

These things can be fought but frankly, were I in your position and if there is much money involved at all; I'd consider retaining an attorney unless you truly feel confident in taking this on yourself.
