I sent them a request for documents ( original signed c.c. application, all billing statements and all signed receipts) they are saying that they do not have any of this info and that it has been destroyed. yaddah39 Posted January 12, 2009 Report Share Posted January 12, 2009 happy new year. i'm dealing with asset on a similar case. they sued me for an old cc debt in 2007, i foolishly signed the consent judgment because i had no idea about SOL. it's been a complete nightmare with them and it's nothing i can do about it since it's been over a year where i could've had it dismissed.in your case, if they can't prove it then have it dismissed. if you're SURE this is an old debt beyond SOL then that's your defense to have it thrown out. nothing they can do to you legally. don't make the mistake i did. my attorney will sue other CA's that have clearly violated the FCRA and FDCPA if we win, which i'm sure we will cuz i have tons of evidence, we will make a small settlement offer to asset and be done with those idiots.
