Destroyer Posted January 14, 2009 Report Share Posted January 14, 2009 I had posted a long time ago about issues I had with a collection agency on a car that I had totalled and found out later I had no insurance on.Two collection agencies had called me. With debt validation letters, I got rid of both of them.Now, a third one has contacted me (it's been about 6 months). When I spoke to them the first time on the phone, they refused to send me anything in writing. They said it was a violation of the fair credit act. I told them I had an attorney (my husband talked to one through his legal plan), but I didn't want to give them the name.Then they called my ex-husband, whose name is also on the loan. I have no idea what they said, but they offered him 50%. He tried to get me to pay it, which I am not right now.They are calling me again. They said it was a violation of the fair credit act.The above statement is a complete lie. Not only does the law not prohibit them from sending you something in writing, FDCPA requires it. They lied to you once, they will continue to lie to you.Thanks - then I'll continue to not return their phone calls. On that first phone call, they told me my current address. So I'll wait until I get something from them, if I ever do, and then send them the standard debt validation letter that worked for the other two collection agencies (the second collection agency, I sent them several followup letters, all by certified mail, and they still never responded). It also had our attorney's name on it. I don't know how they got it, since we just consulted the attorney for advice. We never had the attorney actually talk to the collection agency. Maybe I mentioned it on the phone to the previous collection agency.Anyhows, with this letter in hand, we'll do the standard debt validation. The first collection agency never responded. The second one didn't have two letters. This is the third collection agency. Or would it be better to just settle the 50% now?
