I was taken to court by Asset Acceptance LLC for a Fleet credit crd in fl for a debt.It was 5 mos before the sol.I had consulted a bk lawyer which was an insulting expierence.He took my $100 and sent me out the door saying He could not help me.At the hearing they were on the phone.The judge didnt even look at my papers for my defense.basically they made the rules.I was told to pay $100/mo and talk/negotiate with them on the phone @ home.That was basically the same -they wanted 20k + for a debt of 10k.They said they would not charge interest and I should be grateful for their offer.I asked if @ any time if I could settle for a lesser amt and he said yes.They sent papers for me to sign agreeing to pay the 20k in which for the past 18 mo I never signed.Last Jan I wrote and for two mos asked for a settlement amt in which they never responded. Yesterday I finally recievd paper from the court saying that I had agreed to those terms verbally and the judge ruled in their favor and executed the judgement. Now I know that they were the 3rd party that bought the debt and I know they did not pay 13k for it and have added 7+k to it . I have paid 1900 and now really do not have funds to continue.I do not work for i am the caregiver of both of my parents who have alzhiemers.I have no cars/property but I do sign on several bank accts to pay their bills.I do not know what to do -if I stop paying will they sieze my parents accts/property. I am legally married but he had nothing to do with this and he has all his properties,cars in his name.But he also has me on one acct so I can manage his affairs while he is on the road in his job.Advise?Please.These people have been ruthless,threatning but it is my word against theirs.

You will first want to pull a copy of the court report to see how the judgment stands.

As far as them being a third party or not paying a lot for the debt, none of that matters now if you have a judgment. If you believe that you never agreed to the verbal terms that you mentioned, then you can try to get the judgment vacated. But because it's been over a year, this may be difficult. But it's possible and worth a try.

No, they cannot seize your parents property. However, they can try to take money out of any bank account with your name on it. You may want to take your name off of any joint accounts you may have with your parents or husband.

Get the court file and take it from there.
