livedebtfree Posted January 16, 2009 Report Share Posted January 16, 2009 Hello, I am trying to settle with CA and at the same time I am going through a lawsuit with Midland Funding. These are the last two I am trying to deal with and then I will be free!! I am sending a counter offer to the one I am negotiating with. It is a 2 - 3 year old debt and I am trying to get them down to 50%. Do you think it is wise that I state in my letter that I am going through a lawsuit right now, this is all I have to offer and that my wages may soon be garnished, even though I am trying to fight Midland for proof of this debt? I don't want them to feel that I am threatening them with (if you don't take this then you don't get anything because it will go to Midland) will that just piss them off? willingtocope Posted January 16, 2009 Report Share Posted January 16, 2009 First, I doubt if they'd beleive you...all they want is "their" money, and they don't care about your other problems. Second, if they do beleive that you have another CA winding up to sue you, they might be inclined to jump on the bandwagon in hopes of getting there first.So...no...I wouldn't mention it. What happens when you have offered all you can and they still want more? Can I just keep increasing it 200 dollars or so each time and stretch it out as long as I can? I can't wait to have it all done with. If they will only come down a certain amount do you think I would have to give them what I can in a lump sum and then take payments?
