Eman
I'm being sued by a law firm here in OK. I recently received a request for admissions and interrogatories. There are no CA's listed on any of my CRsin reference to this debt (GM card, $5200.00) I read the following in a ripoff report:I responded to the Requests for Admissions and Interrogatories and Requests for Production of Documents with a certified letter to the CA and the court. The returned back my response. In my response I denied signing any contract with the Plaintiff. Most my answers were 'I do not know, because the Plaintiff failed to provide debt validation' and 'No information to provide, because the Plaintiff failed to provide debt validation' and 'I have no knowledge of this debt being owed to the Plaintiff; therefore I have no documents to provide.'I don't want to lie to the court, but the above suggests I didn't sign or don't owe the CA anything, right? If I answer as such, will I be okay? Appreciate any feedback.
nascar
Relying on the "they failed to provide validation" excuse for not properly responding to discovery requests is a pretty good way to give the other side an easy win.
willingtocope
...I didn't sign or don't owe the CA anything, right? You need to sort out some terms here. Is it the OC that suing you through an attorney? If so, then you probably did sign a contract with the OC. If its a Junk Debt Buyer (JDB) suing you, then, no, you never did sign a contract with them. You may still be forced to pay a JDB, but you respond to their demands much differently.
Eman
I realized, after I posted, that it's the OC who is sueing me. My court date is the 29th of Jan. SOL is past by a few weeks, that is if OK is 3 years on credit cards. I haven't been able to find out here if it's 3 or 5 yrs.
swirlgirl
Question: Did you even request validation before the lawsuit was filed?
merrybucks
Lying to the court would be perjury. I don't think you want to go down that road.
Eman
Question: Did you even request validation before the lawsuit was filed?Yes I did. They sent the standard credit card company name, acc # and balance. That's it.
swirlgirl
So they did validate. See what Nascar said. Remember this is the OC.
