Howdy all, have this question and need a little advice on it's answer.

Interrogatory #6

State each and every defense not specifically plead thus far which the Defendant intends to raise at the trial of this case and list all proof, evidence, and what Defendant's contentions are in regard to each such defense.

Got the others figured out, but this one slowed me down. Wanna get it just right. Anyway, thanks to those who reply!!

They basically want you to tell them each and every defense you plan on using in this case.

Personally, I would object on the grounds that the question is "overly burdensome, broad, and irrelevant". Come on - EVERY defense? Hell, you should tell them you plan on raising everything from temporary mental insanity to Stockholm Syndrome(JOKE!!!)!

They basically want your playbook. Don't give it to them.

*The advice above is strictly my opinion. Check with a real lawyer before you follow any suggestion I said. And if you DO use Stockholm Syndrome, try and do it with a straight face, ok? 8-)

No. They are asking you if you have discovered any affirmative defenses since you filed an answer. If discovery has lead you to believe that additional affirmative defenses are appropriate, then you should answer. If not, simply say that you have not discovered any additional defenses, but will let them know if you do.
