However, I would imagine that in order to get the references in the first place, they would have to talk to you. Otherwise, how would they even know such references existed. nascar Posted February 8, 2009 Report Share Posted February 8, 2009 If you're asking whether or not an original creditor can call other people in reference to you and your unpaid debt after having discussed it with you, I don't know of anything that prohibits them from doing that. They are not subject to the third-party communication restrictions in the FDCPA. Now, I'm not saying that there isn't some other area of law that doesn't protect you against the emotional distress and embarassment caused by original creditors if they repeatedly contact your friends and relatives regarding your debt, but the standards are going to be different than those stated in the FDCPA.
