Cavalry is now in my sights

I just got back from the court house and filing against Cavalry as well as Tate & Kirlin. I posted about this a bit in the past and decided to move forward with legal action.

I found all my paperwork from years ago and discovered I had made a timely dispute, Cavalry has never validated, however they continue to assign to a different CA about every six months. I dispute with the CA and they go away. BTW, this is a debt that has alternatively been identified as anywhere from 18 years old to 10 years old, and I honestly do not recall having an account with the OC's they claim (It changes from time to time).

Latest CA is Tate & Kirlin and they listed it to my CR without the dispute notation and at least 3 years after the limits for listing a debt. When I disputed with the CRA they deleted. My car insurance went up due to this and now my home owners insurance as well. I found out about the listing when I got the adverse action notice from my insurance company.

My complaint is based on Continued Collection, violating several C&D's as well as failure to communicate the debt is disputed (Cavalry to Tate & Kirlin and Tate and Kirlin to the CRAs).

I gave them plenty of chances to solve the issue besides the disputes as they received an ITS, and an ITS with Draft complaint. I have never received any communication from any of them other than their dunning notices. It appears to me that they will not stop the Merry-Go-Round without a subpoena, so now they have that.

I filed against both Cavalry and Tate & Kirlin, they can fight each other for who is at fault for listing it to my credit report. Either way I would guess that it is going to be expensive for them now that they must hire a lawyer. To come out to this little county in the middle of no where.

Today I came home to a voice mail from an Adjuster for Tate & Kirlin's Insurance Company wanting to settle. They have about a week to answer and they send the Insurance Adjuster after me? I guess they are ready to pay attention now that a suit has been filed.

Oops, I was thinking of how long Cavalry had to answer as they were served on different days. Tate & Kirlin has less than 24 hours!

It turns out that their insurance guy could not read a summons and wanted to verify that I had indeed filed this case and WHERE???
