Anyone know of these people and how they operate?

I got a letter today from them, it about an old CC bill from Lowe's that is from around 2000 to 2002. I was the co signer on this with an ex girl friend, yes I learned the hard way.

Any how they also sent the same letter to my father in law in a different state.

I think SOL here in Indiana is 6 years but I need to check and see.

I am not going to pay this. I have not had contact with this girl since 2002.

What steps should I take to get these people off my back.

The letter says that they purchased the account but does not say when.

They offered my three ways to settle.

This likely falls under the 10 year SOL which means, of course, it's still in statute.

I understand you not wanting to pay it under the circumstances and you certainly can refuse to pay it, but if it's in statute and if you were a co-signor on the account then you are liable for the entire account and they can go after you with all the tools at their disposal.

As to RJM, from based on what I've read here they are about as scummy as they come.

EDIT: Now that I look again; this may be either 6 or 10...I'd suggest you do some digging to see what SOL IN courts have applied to credit cards...if it's 6 they you are in luck!

Gunny-

SOL,in Indiana for this debt is at most 6 years. This is 2009, and last payment was.... when? You don't know when your ex-GF made it. Find out. If it is more than 6 years ago, a nice FOAD letter would be in order.

WHEN they purchased the account is irrelevant - when the last payment was made is what matters.

Been having probs finding this out as I have seen contract laws at ten years and revolving accounts at 6 years but nothing specific on cc debts. I don't know if Indiana considers cc's contract or revolving or what.

From Carreon & Associates web site (they are attorneys):

STATE: INDIANA

INTEREST RATE

Legal: 8%

Judgment: 8%

STATUTE OF LIMITATIONS (IN YEARS)

Open Acct.: 6

Written Contract for payment of money

(executed before 9/l/82): 10

(executed after 8/31/82): 6

Written Contract (other than payment of money): 10

Written Contract for sale of goods: 4

Domestic Judgment:

10 on real estate

20 against the person

Foreign Judgment: 10

I doubt this was from before 9/1/82

well i am married now, not to the same gal that had the card. And my wife has a credit score in the high 700's last time we looked it was 790.

And with the new judge in place, who is retired jag officer, I have managed to get all my judgments from when I was on active duty vacated with prejudice, and the judge also made sure iI got the proper paper work to get the judgments deleted from my CR, I can now close on my new home, which will not have a mortgage cause I paid cash for it. I come across a really great deal on a farm house in the country with thirty acres that was a forclosure and got it for a hundred grand under market value.
