dv response from original creditor

I sent Alliance One a debt validation letter on February 19. This is the 4th debt collection agency that has bought my Citibank debt. The Citibank account was charged off March 2007. Today I received a letter from Citibank stating that they received my dv letter and are looking into it. Why am I getting a letter from Citibank if the account was charged off in 2007? Why am I not getting a letter or response from the 4th debt collector-Alliance One?

My guess is that Citibank still owns the debt and is just passing it around from one CA to another to collect on it. Since the CA is collecting on Citibank's behalf, Citi is responding to the DV request.

If that's wrong, I'm sure one of the big hitters will be along shortly to correct me. :D

Sounds fishy, but the passing around does happen. You might even receive a letter from Alliance One. I remember dealing with these guys in the past.

Keep up with your paper trail and DV letters. Continue the process even if it goes get passed along. You never know what might happen...in my case with Alliance One - I got a letter stating, "We do not have enough information on this account and we are going to remove it from your credit report."

It might be even a good thing if Alliance One gave up on this account and sent it back to Citibank. This might allow you a chance to work with OC; not the CA. You might be able to crack a deal/settlement with them.

Keep responding to the letters, though.

...gosh, you have me thinking so hard about this one...I never had this happen to me...maybe the big guns can help me out with this one.

I received another letter today from Citibank that stated that I had 15 days to call them to discuss the details of the dispute and if I don't I presume that I accept liability for the account. Does Alliance One not have to validate this debt? I do not understand.

Maybe Citibank took control of the account again?? Might want to make sure of that b/c you might not have to deal with Alliance One at ALL, which will be great on your part. It's always best to deal with the OC, but if this is true, Alliance One (if it is) needs to get rid of this collections on your CR.

PS - I would talk with Citibank and make sure you write down everything they tell you, and get the name, number from the rep.

No. The CA does not have to validate. All the FDCPA requires is that the CA cease collection activity if the DV was made in a timely fashion. Which clearly the CA has done.

What the CA has done is send it back to the OC. That is common in this situation. Clearly, the OC still owns the debt. The OC can pretty much do whatever they want since they are not subject to the FDCPA.

What is your beef? Is there identity theft or otherwise something wrong with the claims of the OC? Are you using the FDCPA in an effort to avoid paying the debt? The answer helps drive the strategy.
