mt2va Posted March 25, 2009 Report Share Posted March 25, 2009 Can someone point me to a sample letter or two that can be sent to an OC that is claiming I owe them money & I don't. I have disputed with the CRA & I suspect it will come back verified as I have just gotten a letter asking for payment from the OC & this is the first I've heard from them. The supposed date of delinquency is in 2004. I know I can't send them a DV letter so I wasn't sure what I should send them. Link to comment Share on other sites More sharing options...
Robert Nashville/Savannah Posted March 25, 2009 Report Share Posted March 25, 2009 While the DV process doesn't apply to an original creditor (although some states have extended FDCPA type obligations on original creditors); the letter you should craft is going to be very similar because for the most part, you are going to be asking for the same sort of information.When you say you "don't owe the debt"...why don't you believe you owe it?Why does this creditor believe you do owe it?I"m not asking you to give me an answer; rather, I'm suggesting those are questions you should ask yourself because the answers should have a large bearing on what information you are going to ask for from the OC.Also, what is your goal here? If you ask for proof you owe the debt and they send it to you; are you then going to pay the debt? Or, are you hoping they'll send some information that will help you prove you don't owe the debt?Keep in mind, however, unless you have some data/documents, etc that substantiates that you don't owe whey they say you owe and/or unless they provide the proof you need to show that; it's rather unlikely that the creditor is going to change their mind...if you can't change their mind and prove they are wrong; they have no motivation to change their reporting. But I would like to see if they have something showing that I agreed to be responsible for these charges. It is from a mail order company that while I have heard of them (big name brand) I have never ordered from them nor have I ever paid them any money. I guess maybe I should wait to see what I hear from the CRA before I contact them but just thought I would take a look at some letters in the meantime so I would have some point of reference.
