Unresponsive CA

Recommended Posts

I've been working with one listing for a while now. I received nothing from the CA to start with - found it on my CRs. Disputed with CRs, verified. DV'd CA, nothing. Re-verified. Filed with BBB & FTC, received letter from CA giving a excel sheet of charges from a CC company (very generic - I can easily replicate). I responded that it wasn't mine and asked for original documents. No response. BBB & FTC basically said they couldn't help. I sent letter to the CC company requesting an investigation (they aren't listed on CR) - no response.

I've sent multiple threatening letters to the CA - no response. I've sent letters offering to PFD for a lesser amount - no response.

There is no date reported on my CRs, it doesn't update like most collections, but rather that I am 'paying late' (I've never made any payment) and reads more like a revolving or installment debt on which I'm deliquent.

The problem is, I need this gone. Should I send yet another letter, another offer, or can I sue? I really don't want to pay a $1K+ debt that I don't owe - but it has to go. Have they actually validated or not?

I'm really frustrated with this. Any advice is appreciated.

I specifically stated that I did not feel that they have properly validated their claim and that in no way do I feel that this debt is mine. In my letter I explained my motivations as making a final attempt to settle their erroneous claim out of court.

Since they have not responded, my question is - can I take them to court.

Why don't I owe the debt? Because I've never heard of the CC company - and had to do a lot of research to find them. MCM I've heard of. Once, 5 years ago I had a CC go to collections and, not knowing what I know now, I paid them. Since then, they have 'claimed' that I've owed half a dozen "debts". Before now, they've gone away with a challenge - only once did I have to get the BBB involved and they immediately withdrew that one. I don't know why they're so stubborn about this one. I don't feel that it's identity theft since they are the only people involved and nothing else strange has happened to my credit. Personally, I feel that they think 'hey, she paid us once...'

I just don't know what to do...

You said,

"I've sent letters offering to PFD for a lesser amount "

More than likely by doing this you have acknowledged that the alleged debt is yours, and have therefore lost most of your options.

I wouldn't say so as long as she put the appropriate language in her offer.
