energizer Posted April 1, 2009 Report Share Posted April 1, 2009 I have been sued by cap1 for 4 accts on the same suit (biz + personal) credit cards.totalling nearly $32,000. I have been represented by lawyer and lawyers have requested movement, however cap1 has decided that they are in no hurry/rush to get going on the case. They have shown the attitude to wait it out long enough to know that they would get something out of me.Is there anything I can do or have my lawyer work on to get going and see the light at the end of the tunnel. I am simply surprised they are absolutely positively not moving or have any intent on moving forward anytime soon.Its been six months so far since the answer was submitted by my lawyer.help plz. Recovering Attorney Posted April 1, 2009 Report Share Posted April 1, 2009 Frankly, in a civil action, the defendant sets the tempo. So beef up the discovery and make the plaintiff work. Lawyer is asking that we show them two last years tax returns which show negative biz income (net inc=-1) and (AGI= < 7000 for tax yrs 2008 and 2007)any suggestions.
