wahoo238 Posted April 3, 2009 Report Share Posted April 3, 2009 I remeber vaigly a year or so ago collections for taxes, though can't remeber if state or Fed, the CA were allowed to collect but not allowed to report a TL. cjtx Posted April 3, 2009 Report Share Posted April 3, 2009 FDCPA does not apply to tax collections because it is not a debt as defined under FDCPA for an "obligation or alleged obligation of a consumer to pay money arising out of a transaction...". There was no transaction, so the debt is not covered.If they are reporting to the CRAs, they are subject to FCRA just like any other DF.Your state may have other consumer laws that may apply to these debt collectors who may try to abuse the system.
