Liz Posted April 6, 2009 Report Share Posted April 6, 2009 Hi, I have conference tomorrow, am being sued by cavalry for 7K , old car loan. I made my last payment summer 02 This past Aug. I started hearing from cavalry. I got summons served Dec.23,08 (it was signed by judge in Oct.) I sent my answer on time stating possibility of sol. I requested payment history to cavalry and got junk in the mail, old registered letter receipts etc... This is complicated because car was repo in fall of 04 because of judgement for Discover(have paid) said they returned to lienholder. Cavalry keeps inquiring on my credit report. My report has charge-off Nov.02for car. Does sol begin date of last payment, ucc in Mass. is 4 years, does it come under that ,someone PLEASE help me for what I am in for tomorrow. ThanksIf your state has the 4 year SOL then Cavalry is SOL........it would seem that this will fall off your report in the next 10 months.As long at the prior judgement has been paid and you have proof, take it with you, you also may have violations against the JDB, but your post is confusing as to how discover was involved. I paid my last car payment summer 02, never heard from my original lienholder, I contacted them a few months later when I was working again and they said my account was no longer with them. Well I drove this car unti fall 04 and it was repo by collection agency who had judgement for discover. I told them it still had old lien and they said it would go to lienholder and I paid the judgement in full myself. I totally forgot about this car until cavalry entered my life last august.
