Moog
Just got a new collection letter from a company called 'Capital Management Services'. They are attempting to collect a debt for the wonderful folks over at LVNV.First off, why is it legal for a JDB like LVNV to hire another company to try and collect? Are there any restrictions at all on these people or is it just one giant free for all?!Secondly, who do I DV on this one? LVNV has tried to collect on this account in the past so I am no longer within the 30 day period with them. Is this how they go about collecting anew without allowing one to DV them directly?Do I just DV the new CA collecting for the old CA (!) or do I DV them both? Can I use the '1-2 punch' on this one?As always, any advice is appreciated.
admin
Always send your DV to the last people who sent you the mini-miranda letter.

OU812B4
CMS was not hired by the old CA, the bought the debt from the old CA. JDB stands for Junk Debt Buyers, they buy debts for usually pennies on the dollar. You will not be hearing from the old CA again. If you don't pay this CA, they will likely sell it AGAIN to another CA, and so on, and so on. Each time you hear from a new CA, the process starts all over again. In this particular case however, the letter clearly states that LVNV is the current creditor and that CMS has been 'engaged' to collect the debt on their behalf. Credithis
DV LVNV directly, CMRRR, this way you avoid LVNV's digusting habit of passing it on to other CAs ad nausem. If they pass it on again after getting a DV then it is actionable continued collection activity. Always, Always DV the head cheese. Skip the middleman CAs and go for the JDB owning the alledged debt. Moog
So does that mean even though LVNV has tried to collect on this before that they are now back within the 30 day limit to validate or is it only the CA they hired that is required to validate? I just had a great phone consultation with CIC and feel like I now have a game plan to attack my overall credit conundrum but this one just came up so I need to address it asap.
