Does this violate FDCPA?

A debt collector just called my wife at her work wanting an updated number for me then proceeded to say that if I did not return their call, he would send a sheriff out to serve me.

Isn't that a violation of FDCPA?

If the debt collector already has your location information, then calling your wife at work would be a violation. If they are still attempting to establish contact with you, then no, there would be no violation.

That remains to be seen. It is a violation to threaten to take legal action with no intent to so, or in the case of the debt collector, without standing to do so. If you do not return the call and a reasonable time goes by without a lawsuit being filed against you, then you could consider that to be violation.
