Statute of Limitations on Medical Start When?

I am located in Texas. I recently checked my credit and requested a simple validation of past collection accounts. Received my first letter back with proof the debt is mine and that they are in charge of this debt. I want to do a simple pay for delete since it is only $50.00 to get it removed quikly. According to the file I was discharged 11/20/2004. The last insurance payment they received was 12/23/2004. I know the SOL for Texas is 4yrs accross the board. I am just not sure of when the official SOL expires...Discharge, last insurance payment, or when the CA received the account???

The CA taking "possession" of the account has nothing to do with the SOL. With medical it would seem logical to me that it would begin either from date of service i.e. your discharge date or from the date the insurance made payment. I would go with the date of service for this reason: You are the one that had the "contract" with the hospital, not your insurance company.

In my business, yes user name signifies health care field, I make sure that patients know that filing of their insurance is a complimentary service and that our agreement for treatment is between the patient and our office. This way no matter what happens with the insurance the patient is responsible for full payment. Insurance companies like to significantly cut the bill and I have to make sure I get paid. I got tired of this and have gone totally cash, it is easier and more honest. My patients all know what there cost will be up front.

This is just my opinion though so hopefully others that have more concrete information will reply.
