cbairey Posted April 14, 2009 Report Share Posted April 14, 2009 I got summons, had 20 days to answer, three days later:filed with court, answer, Counterclaims, C&D and requested Docs,,all sent CMRRR( recived 3/31/09)does the CA have only 20 Days to answer my counterclaims?If they dont answer, can i file a motion for summary judgment on counterclaim? ( 21st day?)Clerk was really helpful,said they havent filed anything since the summons & can take as along as they want "producing docs" ( just dont seem fair) I would assume that a counterclaim has to answered just like a summons within the 20 days, am i wrong?this CA Called one time , then a summons,,,no dunning letter ( i am sure they are supposed to mail within 5 days from the call) i am sure they "thought" it was a easy default judgement waiting to happen,, Suprise:shock: they already screwed up by calling a old neighbor (3rd party) and leaving a voice mail, XXX calling For XXX about $$$ owed to XXX please call us at XXXX( CA was dumb enough to admit they did it when i called them the next day) can you say Violation??? can you say PAY me $$$$ now ,also filed that "violation" with the court, just keep adding to the counterclaimI am in:)++ washington state,,,, Link to comment Share on other sites More sharing options...

cbairey Posted April 15, 2009 Author Report Share Posted April 15, 2009 Have you looked at the Washington rules of civil procedure?I found out after calling the "lead civil clerk" that i could ask for a court date . so back i went to the court and got the date( May 7th 9am) so i sent that to the Ca's atty CMRRR,,,no one seemed to know where to find the document i need,, fiinally found out if you go to wacourts.gov they are "supposed" to have all the court documents,, i will look and hopefully someone here will know how to fill it out the right way Link to comment Share on other sites More sharing options...
