1. Defendant is without knowledge or information sufficient to form a belief as to the truth of the complaint

2. Defendant is a resident of Wake County, North Carolina

3. The Defendant did have an account with Home Depot with this account number

4. Defendant admits being in default to Home Depot with this account

5. Defendant is without knowledge or information sufficient to form a belief as to the truth of the complaint

6. Defendant is without knowledge or information sufficient to form a belief as to the truth of the complaint

7. Defendant is without knowledge or information sufficient to form a belief as to the truth of the averment.

Defenses

1. Defendant received a letter from xxxxxxx, Attorneys at Law on January 28, 2009. (copy enclosed)

2. Defendant requested verification of debt by written letter on February 22, 2009. This was mailed via USPS. (copy enclosed)

3. Defendant received no response to the verification letter from Plaintiffs Attorneys.

4. Defendant was served a Civil Summons on or about March 23, 2009

5. Defendant request documentation that this debt is entitled to Plaintiff. This documentation shall contain all items that were requested in original debt validation letter mailed on February 22, 2009

6. Defendant request a stay on any actions that may be taken until debt is validated.
