motion to strike...

Recommended Posts

do I have to file a motion to strike that customary affidavit sent from the CA with my answer or can I do that at the pre-trial? I filed my answer back in Feb. and just now learned that I was supposed to file then... can I just go into the clerks office and add that motion to the file? This could be a HUGE step back in my progression against this CA... Please advise...

I know that you can object to it during the trial on the ground that it's hearsay...provided it's the typical, rubber stamped kind of affidavit I think it is.
