I'm always a little amazed when I see a question like this.

What difference does it really make? If you've seen one collection agency you've pretty much seen them all...some are a little more scummy than others and some actually try to follow the law while others seem to go out of their way to violate it but at the end of the day, you follow the FDCPA in how you handle your actions.

You will likely need to talk with them, if you haven't, so that the "five day letter" will get kicked off and you can start the DV process.

I don't really understand your amazement. Part of the problem is that many of these companies change names so often. They start as one company , get dinged and then start a DBA. Just wondering if anyone knew who these folks were. Of course I haven't recieved any letters from them as with the others and really doubt I will get one. I just want to find who they are, what their address is and get all the info. I don't like speaking with these companies because quite frankly I don't get a chance to speak.....they yell, threaten etc and when they shut up and you ask for an address you get the "why do you need that?" etc.

So if I can get the 411 without having to talk to someone I can do it all via mail. Thats all I am looking for.

So let them yell...when they are done, you say please contact me in writing and hang up. How you "feel" about their phone call is 100% up to you...you only have to take one phone call to start the clock ticking on the five day dunning letter; after than you can just ignore their calls.

Until a CA has contacted you initially in writing (or you have enough information from your credit report to know who to contact and a reference number), you can't really DO anything as far as protecting/enforcing your rights....keeping a low profile or never answering the phone tends to just keep you in the dark.

True....but I would still like to have information on them.

Well, given that a Yahoo search yielded no results at all and a Google search yields only a reference to this very thread and given that no one else here has tried to answer your question, I suspect you've gotten all the information you are going to get.

I'm also doubtful of your spelling of the name of the agency which may account for the complete lack of hits on the web.

So...while more information would be nice, I suggest you are either going to have to talk with them long enough to kick off the first dunning letter OR you need to simple ignore them altogether.

OK so I called...it is

Hagulworth SB&J

collecting on a payday loan from 3 years ago that was paid in full (I have the docs) but what really cheesed me off is they threatened me with bank fraud. Why????? Because after they had been paid they continued to take more money out of that account (now closed) and because of that they are threatening me with bank fraud.

In OK they cannot even take me to court on this issue because our court system will not hear these types of cases.

Anyhooooo if people are looking for information here it is

"Bank fraud" seems to be he term de jour for bottom-feeding payday loan collections and let's make no mistake; "Payday loans" are the absolute bottom-feeders of the lending industry (and that's really saying something) and those who collect for them are even lower on the totem poll as far as I'm concerned.

They like to throw around the phrase "bank fraud" because they think they can scare the alleged debtor into thinking that the sheriff or FBI will be at their door to arrest them the next day.

Many states have declared by statute that a "payday loan" that hasn't been paid back absolutely cannot be prosecuted as any sort of criminal act...it's civil, pure and simple.

A business with a G Mail account? Sounds a quality outfit

They are a CA and the threat of criminal action is a clear breach.

DV them.

Thanks, here is the really interesting thing....even if I had not paid this it is now past the SOL for Oklahoma and I double checked on the term bank fraud....Robert is right it really has nothing to do with payday loans and in double checking if this company even rolled over the loan (which is what I think they tried to do) it is illegal for payday loan companies to do that in my state.

I was going through some tough times when I did the PD loan but have totally learned my lesson. No need to DV them it is now officailly SOL as of this week.8-)

  • 2 months later...

Hi there. I'm replying to this since Hagulworth have such a small footprint on Google and people really need to know about them.

They conned my wife out of $600 before I knew anything about it. They refused to give her evidence of the debt, threatened her with jail, cussed at her down the phone "I don't give a f*** what you think, b****" etc and threatened her mother (who they'd contacted first).

So we're $600 out of pocket and her mum hasn't picked up a phone call in months.

Hagulworth are out and out crooks. If anyone is reading this after being contacted by them, please seek legal advice before talking with them any further.

Sounds like a good time for a FOAD letter. And in this case, I think I'd actually use the words "eff off and die" in the letter!
