Suing Collection Companies - New Case Law

Recommended Posts

As I'm feeling exceptionally angry/frustrated over a set-back in my own Zwicker case, I was very happy to read this today:

In a nutshell, collection companies cannot leave their usual vague messages on your answering machine. The debtor won in court, and then the 11th Circuit Court of Appeals upheld this.

I am going to have to find a good attorney to start suing all of the collection companies who feel it necessary to leave these voicemails to me.

Yeah they are between a rock and a hard place. Which is good until this gets settled in the law. They HAVE to say they are a debt collector, but if a third party (other than spouse) overhears a message that is from a debt collector than they have maybe violated the FDCPA as well.

Some people wonder why id theft is so rampant in this country, these morons are just lucky they were talking to a family member and didn't call a wrong number, aholes!
