They agree that I can elect arbitration, and I have the right card holder agreement. Anyway they want to judge to state I have to pay the filing fee... Seeing how I want to elect arbitration. And it's clearly stated in the arbitration clause.... bla, bla, bla....I know I know, elect and initiation are not the same thing. I tried to tell him I didn't think I had to pay, but he was too busy being right. I fill him in... in court I guess....Part of me is saying cool... Another part is saying... I have to do what?????? And they have the beef with you So no matter who wants it, they have to pay for it. trueq Posted October 30, 2009 Report Share Posted October 30, 2009 If arbitration is forced by court....thats it for court...for a long time.If JAMS arbitration does ever "get moving", a lot of that can be done by phone and mail.If you maintain court, debt lawyer can keep draging you in and file for continuance.This has happened to more than one person on this board!
