KentWA Posted November 10, 2009 Report Share Posted November 10, 2009 The FTC filed an Amicus Brief in Jerman v Carlisle which is before the Supreme Court on the question of whether mistakes of law are Bona Fide Error under the FDCPA. The FTC overwhelming opinion is NO! Ignorance of the law is never a defense of law.This brief has some interesting case law citations on Intentionality and Bona Fide Error.
