BayChick Posted November 20, 2009 Report Share Posted November 20, 2009 I received 2 Pieces of fishy "evidence" amongst 2 Bill of Sales and the JDB's own Interest Fees and Summmary of Calculation... they are1. A weird looking Credit Report, witch says Equifax, but ive printed my score before and they look different, on top of that the account numbers dont add up.2. 1 Statement with my maiden name and a copy of the back where if you have nay changes in info you can write down, well someone wrote a number with and area code from texas, Im in Cali and always have... now is this to my advantage at all? I have a few days left of discovery, what should be my move if any? The JDB sent the papers for Request of Statement and Witness, should i sent them back that evidence and argue my points? Morganna Posted November 20, 2009 Report Share Posted November 20, 2009 I would object immediately to the production of that credit report ...Those should never be used in court ... aside from the known inaccuracies that exist on them - your private personal credit file becomes "public". Never a good idea ....Second that statement ... look into that alleged phone # and see what you can come with .. that would only further support your claim.When you respond word it in a way that corners them .. So if i have this correct, Object and send them my objection with the evidence they sent me (should it be filed at in court? or just sent to them?), and file a Motion to Strike at the Court House? BayChick Posted November 21, 2009 Author Report Share Posted November 21, 2009 I checked into the number it belongs to Credit Solutions, i looked into them a long time ago when i first got behind on my cards, and the Oc wouldnt work with me. Little did i know they where making it worse, and once i found this great i dropped them, but im not sure how they got the number on there. Not sure if these means that "evidence" is valid or can still help me... i will have to work onfighting with the credit report and their bogus " verification" Still will take anyones advice on what to do with the report and Statement Thanks SO Much!! The papers they sent me state " Do Not File with Courts" but i think it states for any evidence i plan to submit during court... but if i file the Motion to Strike, it has thru be done thru courts.
