A general question about FDCPA

Recommended Posts

Awhile back I was reciving robo calls on my cell phone... They CA had the wrong number, they told me to hang up if I wasn't this person, but the only way to get the number to call back and let them know it was a wrong number was to listen to the whole message.

Could I have sued under FDCPA? $1000 for each call.

It's too late this time, the info is gone and it's past SOL. But next time.....

Karen,

We recently debated many elements of the TCPA and there are several case sites in the thread. Although the original question was application to home phones, we were all over the road in that thread. For your case I belive Watson v NCO is on target as NCO was calling the wrong person on their cell phone.
