mrsfrustrated Posted December 15, 2009 Report Share Posted December 15, 2009 I did try to find if this question has been asked, didnt come up with anything.anyway, portfolio sued me a couple of years ago, their lawyer didnt bother to show up for court. the judge got me on the phone with him, said he was going to get me some info and mail it to me and never did. (because i told him i didnt know what i was being sued for)a few months ago i started getting calls again, so i sent off the letter to cease and disist (green card). now they are calling again.the sol is up in feb or march of 2010so do you think these bastards will go for it again? the last time i ignored them until i got the summons so i think they thought i would be a no show, i plan on pretty much doing that again and hope the sol runs out.just wondering if anyone has had a similar case with them and how it turned out.thanks Link to comment Share on other sites More sharing options...

Like you, my wife ignored them until they sued her and served her. I stepped in, and we mounted a defense: Answered, hired a lawyer, etc. They sued with 2.5 years to go on the SOL. The case wound through the courts, and they dismissed without prejudice with 1.5 years to go on the SOL. Never heard from them again.So while technically they can sue again if the dismissal is without prejudice, I think the chances are slim. They'll go after easier targets.
