I am writing a MTD on the grounds of not being given the right to cure and no evidence after discovery due date. New question though - If Midland purchased the alleged account from the OC AFTER filing the suit against me, were they legally responsible to file an amendment to their complaint that states they are the owner? It is my understanding that a plaintiff cannot be and assignee AND owner, at the same time. Your input is greatly appreciated.I'm dreaming of a Midland-free Christmas.
