tigergem
Wow. Today on PACER, on my Chapter 13 query I see that there has been a request for notices by a creditor I didn't even know was a creditor. They are not listed on my schedules because - yeah - I don't have a clue who they are. What kind of proof can I demand that they are entitled to receive notices? Or should I? Just send the notices? And if they try to file a claim, object to the claim?
Denita
Yes, object to the claim. Are you pro se or do you have an attorney?
tigergem
I'm Pro Se.I am on totally top of all my deadlines, but not without a few more gray hairs.Everything that is due to the trustee 7 days prior is already in. (My 341 is 1/6/09) I have already mailed my first payment. I think I am doing ok. Well. Except for my nerves. So am I required to send this creditor copies of all the notices that I have already sent to everybody else on my matrix? And if so, am I required to separately inform the court that I did so? tigergem
Ok I just called the BK clerk and wow, are these people ever helpful. I try to limit my calls to them because I don't want to be a pest. I was told that I do not have to serve this creditor with any of the notices that I already filed because they were not on my matrix as of the date of my filing and service upon the matrix. She was also very encouraging. She said we DO have successful Pro Se debtors, you know.Actually it is really a good thing that I called the clerk's office about an hour after my FedEx notification of delivery on a document today because the lady who received it is not in the office today and it might not have gotten filed today. But I was under the deadline anyway, so it was all good anyway.
