Shortly thereafter, I received a collection letter from Arrow that they were collecting on the account with a balance of $219.54.I sent a letter to Chase telling them the account was closed and PIF. They respondeed with a letter stating they had made a mistake and the account was indeed PIF.Fast forward to December of 2009. I received a dunning letter from Asset about the same account and amount. I also found they did a hard pull on my EX CR. I'm really ticked off. Foutunately I saved all the letters from Chase and the collection letter Arrow.Do I have any legal recourse against Asset? What about Chase?Thanks for any input. Sounds like they will not be able to verify the debt with Chase although one wonders what mistake has been made. Even if a balance were owing, it is very old---almost too old to be reported.I would tell them that the account was PIF almost 7 years ago and that you have correspondence from the OC to that effect. Ask for a copy of any verification received from Chase and advise them to make sure there are no errors in the account number.Finally, I would tell them that you enjoy a good credit rating and you will hold them responsible for any adverse reporting of this account which has been PIF for many years.Good Luck. 1 Link to comment Share on other sites More sharing options...
Biddybaby Posted January 11, 2010 Author Report Share Posted January 11, 2010 I have a NACA attorney who is filing suit against Asset for both FCRA and FDCPA violations. FCRA for pulling my report without a permissible purpose and FDCPA for trying to collect a non existant-debt. He's also suing EX for providing Asset with my report.
