DV to Unique National Collections

Has anyone had success sending a DV to the monster we call Unique National Collections? I need some suggestions.

I had a library fine with them. Disputed with CRA. TU...deleted...Nice!

Not on EQ, remains on Exp.

Paid it with the OC.

Got advice to DV then MOV.

Anybody did this? If so how did it work for you?:?

Yeah...I am going to do that now.

However, if you do a search on Unique National Collections you will see that they are tough. Also, of the three CRA's, Experian seems to be the toughest and most difficult to get things removed.

So I say that to say that I am dealing with the toughest of the tough!

And.....I saw a friend of mine today who works for the library and when I told him the situation he just shook his head.

But I am ready to go to war.::BigGun::

I think you just need to follow the process and see how it plays out. Is the flowchart still in use by folks here? Worst case scenario you pfd 'em if they validate, no?

What I did was paid the OC, then I DV'd the CA. So I can't PFD'em.

Now I never had to deal with a CA, so I am a little stuck. Just waiting for the response.

To Whom It May Concern:

I just pulled a copy of my credit report and noticed that your agency is reporting that I owe you a debt. I was not aware of this debt until now, and under my rights under the FDCPA, I request that you validate this debt.

Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (B) that your claim is disputed and validation is requested.

This is NOT a request for “verification” or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

Please provide me with the following:

# What the money you say I owe is for;

# Explain and show me how you calculated what you say I owe;

# Provide me with copies of any papers that show I agreed to pay what you say I owe;

# Identify the original creditor;

# Prove the Statute of Limitations has not expired on this account

# Show me that you are licensed to collect in my state

# Provide me with your license numbers and Registered Agent

At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau’s (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:

* Violation of the Fair Credit Reporting Act

* Violation of the Fair Debt Collection Practices Act

* Defamation of Character

Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.

this is pretty standard. It is not harsh. Some would interpret it as over reaching (not me) for a DV. The problem is that this is paid but that might help you in disputing.

once a debt is paid then are disputes to the CA under 623? Is this CA actually trying to collect?

Are you going to send the proof of payment?

I don't know too much about "623" I will have to search that. I thought that was only for OC.

As far as sending proof of payment, I don't know. I might just wait it out.

I just want to know what happens when a debt is paid to the OC after a CA has reported to the CRA.

Never tried that. I never had to deal with a CA and this is the first time I had to DV.

So I should MOV the CRA with a green card copy huh? How should the letter be set-up?

Will send it tomorrow. But won't the CRA see the dates and tell me I gotta wait till the CA get back to me? Or am I giving them too much credit...:D

They sent nothing close to what I asked for. I got a copy of an email somebody sent to somebody else stating that this was a valid debt that was paid and it will show as a paid collection on my credit report....blah blah blah.

And they sent me what looks like a print out of what I owe and it doesnt say I owe anything. It has my account number and nothing stating that I owe or have owed anything.

Here's my question: What is the next move? and How do you get paid collections knocked off a report?:roll:
