California, but none has answered to my emails or messages left at their voice mail!Does anybody know an actual NACA attorney who would, at least, return a call?Are they so busy that can afford to ignore a request?Thanks for your help. They advertise as debtor's rights attorneys, but try to steer you into bankruptcy.Filing and winning a suit like yours is expensive, and not worth the attorney's effort. Not enough reward for the risk. You could go it alone, and you might win. This board has all the information you could ever need to win a case. trueq Posted April 15, 2010 Report Share Posted April 15, 2010 (edited) in my state that will take these cases and win them!The rest will, sometimes erroneously, steer you toward BK.In my case, 3 different BK attorneys, one of them the best in WI, could not convince me BK was the best thing.2 years in restrospect on looking back at the "top" BK consult, BK would have been a horrible mistake!I've laid complete waste to the debt collection industry.conservatively, I've cost them AT LEAST $250,000 in lawyer fees. (and that is VERY CONSERVATIVE) I've gotten $200K in debt termination, Had $375K go out on SOL (which will open up future dumb debt collector opportunity for me for sure!), I've taken $11K in cash from them, and they have only gotten 30K from me, but I'm going to be getting that 30K back. (I'm going on offense against the 1 bank that ever beat me!)This does not even count the big 3rd party hurt I helped to put on Cap1, with everyone's helpful cooperation and willingness to try a maverick, winning idea! trueq Posted April 15, 2010 Report Share Posted April 15, 2010 (edited) Honestly, in your case, bk would not have been a terrible idea.you were aware of my non-exempt asset picture.I was over Ch.13 limits, payment would have been voluminous anyway.Ch.7 would have cost me the non exempt assets.I won on one count anyway. Our state's homestead exemption went from $40,000 when we were considering BK 2 years ago to $150,000 today.So even if I need to "blow it all in", I made $110,000 on the fight on that front.But its looking a lot less likely that I need to do that.The fight has been work, but I'm much better for it. I will recommend a couple of good lawyers.Also, everyone should be aware of how you should present a case to the lawyer. Almost every NACA attorney I know is not looking to get rich in his or her practice. But they do have to make a living and can't take every case that comes in the door. What you need to highlight, if possible, is that the case will generate sufficient damages so that you can be happy with the result and the lawyer can make some money.So, if you were forced to take a loan at a higher interest rate or couldn't buy your dream home, or lost your home, or suffered severere emotional distress (and that is compensible in your case), you need to highlight that fact to the attorney.
