Wife is self employed but has shown a net loss from her business the past two years. Because she had less than $400 in self employed income and I had zero we were not required to file a return. We have basically lived off of our savings the past two years and it is running out. My question is this: can we still file a chapter 13 without returns? Her business is starting to take off and we expect to not have a loss this year. Will bank statements work? I do have the unfilled returns that show the loss.We live in Tennessee. ColoradoBelle Posted August 5, 2010 Report Share Posted August 5, 2010 I believe that you can file your returns up to three years after they are due, especially in the case of not needing to file.I'm in a similar sitch in that I didn't have any earned income and less than threshhold unearned income back in 2005,2006. I filed and just yesterday the IRS sent me a questionaire re the BK and not filing....so they do check. I wrote back and told them I had no taxable income and what should I do.
