Collection agency won't give money back

I paid off a debt with American Credit Association LLC the final balance was $20 and I sent in a check for $25. When I contacted the collection agency they stated that it was being investigated and that I might get my money back. Now I understand it's only $5 but it's mine. The rep stated that they don't have to refund the $5 back that the law gives them a $5 cushion when it comes to matters like this. Are they right if so where are they getting this from, if they are wrong how do I get my money back? And what other legal support do I have.

You know how to tell when a CA is lying? Their mouth is moving...

There is no law that gives them a cushion of any kind.

Unfortuenatly, to get your money back, you'll probably have to sue. You might try contacting your state attorney general, but, it might be tough to get them worked up over $5.

First, why did you send $25 instead of $20?

Second, they are lying to you. You aren't getting your money back, because they know you won't do anything. It's only $5.

Third, if you do want to do something, file a complaint with your state regulatory agency. At least they might have to spend a few dollars responding to your complaint. You can get your pound of flesh - in this case, only an ounce perhaps - that way. :)++

Consider filing an FDCPA suit against them. Try to get documentation of what they said. If you can legally record it, do so. After you get the documentation that they are claiming rights to collect they don't have, contact a good consumer lawyer and let them fight for you.

I just found out that this same collection agency is on my credit report now that I have paid them how do I get them off? Do I still follow the debt validation process or is there another way? (I now I have violated every rule in the book this is one of those situations where I knew better and didn't do it smh)
