Discovery response help

Recommended Posts

Yesterday I got a letter from the lawyer/debt collector. Title is Plaintiff's request for Admissions Propounded Upon Defendant. In the instructions it tells me that my wife has to admit or deny under oath and in writing the following statements. This followed by 9 statements in regards to the account. Is there any answer other than confirm or deny that is acceptable to the court? also I got this in the regular mail and the lawyer requests I send it back to him.

Also after the 9 questions at the bottom of the page in Bold face is NOTICE TO DEFENDANT: WARNING: THIS IS AND ATTEMPT TO COLLECT A DEBT ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.

Am I looking at real discovery paperwork or is this some hinky trick . Can I check with the court to see if they have added anything to the lawsuit?

Discovery is usually done outside of court and then used for Motions or Trial, them sending it regular mail isn't a problem. I always send certified back, so they can never say defendant failed to respond.

There is no way to offer you assitance with the questions unless you post them, redact your name and pertinent information to protect your identity.

You will then recieve assitance from the forum on possible answers...
