Considering Filing BK myself

I would like to file for Chapt. 13 by myself. Back in Oct. 2004 I used We the People to file Chapter 7 and everything went fine but I see now that We the People has filed for Chapt. 11 themselves.

Does anyone have recommendations on where I could get the paperwork to file Chapt. 13 myself?

How can they do that when you reside in Texas? Is this the only reason you need to file for bankruptcy (or would it make the difference between needing to file and not needing to file)?

I did not think that they could do this either since we reside in TX and state law does not allow this. But I do not know what my steps would be to fight this or get it dismissed.

And yes, this would make the difference between filing or not filing for BK.

Your Chapter 7 will shut down the garnishment, but you'd be best off contacting the creditor directly and giving them a case # on the day you file. They should (must) contact your employer and have the garnishment stopped. Monies that were already garnished will not go back to you.

Regarding Texas, it depends on state laws. I've heard out of state creditors make arguments that their state law applies, therefore subjecting you to garnishment. Some states, such as mine (PA), allow garnishment only for landlord-tenant disputes, IRS & state tax issues, and child support cases. You have to look up Texas rules. This yankee isn't familiar.

Hello All,

Am considering filing BK myself - Chapter 7, since the cost using a lawyer is upwards of $1500. I used Nolo's online means test, since our income is above state median, everywhich way to Sunday to see if we qualify, and unless I did things wrong - we do qualify.

Have several questions hopefully someone on here can answer.

1.) Has anyone used the online services for the forms, i.e., Garaunteed Bankruptcy Services ($129 for use of their forms) ?

2.) If you file yourself, for the unsecured creditors form, do you list the OC or the CA which has been contacting us?

3.) Currently have a pending Wage Deduction Notice, from a creditor in Illinois (we reside in Texas). I will request a hearing with the Illinois court to dispute this, but according to what I have researched, it appears my employer will have to start to withhold the estimated amount immediately into what i guess would be similar to an escrow account, pending further order from the court once proceedings are finalized. Once I file, does my employer release those funds to me?

What I'm wondering is what happens if you use online forms, then you have found out in court that you have to submit something else, or need another form...one of the offices that sells the papers for bankruptsy told me that another form is around $75...so I'm in question as to what amt. one has to pay, again, for another different type of form. Also, if the cost for the forms from the company you mentioned (of which I scanned their home page) has the court filing fee listed in the list of documents. Okay, you pay their fee and a court filing fee and that will be about the same $400 that one would pay at an office that will, at least, check and verify that you have all things in order. I think the cost runs about the same and if so then I'd rather be able to go into one of the offices and do mine there. Less chance of mistake since you can talk with a live person face-to-face. Just my opinion as I'm looking at doing Chapter 7 and have low assests so I don't need a high-priced attorney but I still want someone to 'guide me.'
