Felt relief that I finally finished it and got it in in time. Now I am wondering what to do next?? Should I contact Cap 1 lawyers or wait? lisser Posted September 1, 2010 Report Share Posted September 1, 2010 What I did was send a certified letter to Cap 1 telling them after reviewing the cardmember agreement and seeing the arbitration clause, I would like to elect arbitration. I waited a day after I knew they received it, called them and had to leave a voice mail. They called me about 3 days later and told me that it was fine if I wanted to arbitrate but I had to initiate it. The day before that phone call I had already filed my MTC or in the alternative stay pending arbitration. They have not received my MTC yet according to USPS. I recorded my phone conversation and am going to send them another certified letter memorializing the conversation and letting them know that we still have a few things to iron out, ie. them initiating bc it's their claim against me.
