joesygirl
Ok lost on default.... and I am worrying about what the judge will give to the plaintiff.? I am a homemaker, i do not have my own cash flow. Will they go after my husbands wages? We have a upside down house in Riverside, CA. we are renting out now and both of our cars are paid off.... What can they go after of mine? How can i pay this, i think they were asking $5000.00. I fought up them in court up until now, where it was just beyond my means, and wasn't able to hire a lawyer. So i guess is all i want to know is how to cover my butt, should i take my name off of the house we own? or the one car in my name? I'm just so worried they will go after my husbands wages, which as you know teachers don't get paid that much... thanks for any help you can offer me. much appreciated! Guest usctrojanalum
what do you mean got a default on a summary judgment and that you lost on default? do you mean there was a MSJ hearing and you were unable to appear?
joesygirl
That is exactly what happened!! I know longer live in that area where the court is and had no chance to get there! so i'm just looking to see what my other options are. And where to cover my butt in case of husbands wages or house..... i still plan to fight, but i'm going to have to get a lawyer and the money is just not available yet! nobk4me
If you don't live in the area where the court is, then maybe the court does not have jurisdiction. Were you served? If so, where were you served? Where you live now? Or at your previous address? If the the case was filed in the wrong court, that is your best chance to fight this. Please post some more details. Chapel Hill
It they have any clue at all they will bring you in for an OEX. If you again do not show and of course they have just a little brain matter they will have go into court and ask the judge to issue a warrant for your arrest. Skip an OEX and expect to have a problem that was winnable become way more problematic. I was on the 1:45 today and saw a really nice commissioner sign a warrant with a $10,000 bond. Better you not bypass the next hearing date if that hearing in an OEX.
