aot2002 Posted September 14, 2010 Report Share Posted September 14, 2010 DV Letter was sent to Credit Control Corp Feb 2010 and they responded with asking for a proof that the debt was not mine letter with a packet of employment information, address details for past years etc...I mailed a new letter requesting they delete from CRA in 10 days because they violated the FCRA law for not validating the debt. They have not responded it's been 20 days.I went to local NY state small claims today, the booklet I got & lady in charge said that NY requires the defendant (CCC) to live in where I am taking them to court?Ok so how the heck do I sue them for my 1000 dollars since I have all proof but this dang state won't allow a lawsuit outside of NY? Either that or find a lawyer willing to take the case on contingent. If you do have the paperwork, then that should not be a problem.They will probably try to settle quick because no sense losing $3000 - $4000 over $145. You might be able to sue them in a Supreme Court which is a $210 filing fee. You may even be able to sue them in a Civil, City or District Court where the filing fee is only $45.
