cookie123 Posted September 15, 2010 Report Share Posted September 15, 2010 I filed my answer w/special defenses with the court and sent copy to the JDB's attorney it now appears on the Judicial website. Today I checked the website to see if any other activity has taken place since the last posting, and noticed that the attorney for the JDB is requesting to revise. My question is (since I am a law dummy). The request to revise would that be to revise my answer/defense, or would it be to revise thier complaint? I have not received anything from the JDB's attorney yet, so I am just curious as to what this may be.I don't know if anyone can help, but I am just so nervous about this case I cannot sleep, or think straight. They can't make you revise your answer. You'd have to request permission for that yourself !!Keep an eye out for their revised complaint !! Challenge and file an objection to anything you can in opposition to the JDB’s attempt. You’ll find info in your Small Claims Court Rules. The best defense is an offense....pick it apart for any "summary judgment evidence" on which the Plaintiff relies. Focus in addition, to what changes they make. Examine what material facts exist in their pleading - of those - what you would consider inadmissible evidence. They will probably go for MSJ next.Opposition wants to revise becuase they missed something and/or found something (a tic) in your answer.Good luck. cookie123 Posted September 16, 2010 Author Report Share Posted September 16, 2010 Apparently they can ask me to revise my answer and/or special defenses for various reasons, I also noticed in the court rules that before they file for revision they are suppose to send the request to me first. I have yet to receive it. In the meantime, I am working on my request for production of documents. I have one question.It says I can seek production of documents "without leave of the court" after the return date. Does that mean I can request the documents without the permission of the court? I am reading so much that I am confusing myself, AGAIN. I am so happy I found this site. Everyone here is so helpful. I do appreciate all the input. cookie123 Posted September 18, 2010 Author Report Share Posted September 18, 2010 (edited) I received a whole packet full of documents from the JDB's lawyer. The contract from the OC, basically everything that had to do with the purchase of the vehicle. I never asked them to send them to me.Anyway, they are all photocopies and look as though they had been faxed a couple of times. I cannot read most of them. The contract is not readable at all, front and back. Really blurry.Should I contact the Attorney and ask them for something I can actually read? Or could this be this is they only copies they have? If that is the case I don't see how this can prove anything.If anyone has any suggestions, feel free to help.
