I received a message from Asset debt collection agency 11 days ago. When I returned their call the person immediate stated that I owed $1023 to a bank and asked if I had a lawyer. I asked for information on this debt and she stated it was from 1996 and was a default on overdraft protection from Hunington Bank in Ohio. I live in KY now but did live in Ohio years ago. I ask her to send me information on this debt. I received a letter two days ago. I am going to respond in writing asking proof of this debt since I really do not think I owe it. Today while sitting in a meeting my cell rang at 2:54pm. I had saved the phone number so I knew who it was but I could not answer. They hung up an called again 2:55pm and then again at 2:56...I left the meeting an answered. The gentleman stated he was calling from Hunington Bank which I knew was a lie. He was with Asset. I said that I had just received the letter and would be responding by letter and that I did not think he should call me three times in a row. He stated he would call me as many times as he wanted as long as he left me no more than one message a day. When I stated that I would like no further phone calls and that we could communicate through writing he resonded by saying that this would only expidite their actions against me. Can I be sued on this debt from 14 years ago? Don't I have the right to ask for proof of the debt? And isn't calling and hanging up and calling right back harassment? Any advice????

Ok they called on your cell phone; did you ever tell them they could? IF no

Do not delete the calls, start a journal and write down every call even if you do not answer. If you talk to someone make notes.

Check to see if you live in a one party state to record the phone calls, if you do get a small recorder and use it. Every time you talk tell them not to call you and that it is against the law, do not go into it with them.

Write them a letter asking them for the normal information that they should have and proof that the account is/was yours, in the letter tell them not to call you at that number and send registered return receipt mail.

Use the search function here and read up on TCPA, you just found some extra money.
