can a nebraska court take my VA disability?

Back in 2005 I had a card through HSBC. I thought my husband paid it off, when we were clearing our debt, but I just received a summons from the court regarding a collections agency here in Nebraska. I guess HSBC put me on collections and it has bounced around till it went to a collection agency/lawyer's office in Nebraska. I am not a resident of Nebraska but living here on a military installation. I do not have any income of my own other than my Montgomery GI Bill and my VA disability. My husbands name was not on the account and I have never gone through anything like this before. I just really need some advice :(

I wouldn't worry about any exempt funds being taken. I've been working in the legal circle for the past 6 years as a legal assistant and process server and I have only once seen exempt assets garnished but it was an extremely egregious case of a debtor hiding assets and basically bragging about it openly in court before a judge.

Your exempt - they will request a "Military Status Report' pusuant to the Service Members Civil Relief Act from the Department of Defense Manpower Data Center. See 50 USC App. 521©

They can not touch your VA disability income.
