TxBigGuy Posted September 29, 2010 Report Share Posted September 29, 2010 Is an affidavit of debt that is not signed by the notary still acceptable?The affiant signed it and the notary stamped but did not sign.Besides arguing its hearsay, can I get this affidavit stricken because it wasn't signed by the notary? Few established law on this - maybe part of the sum but not the whole enchilada.- Defend on hearsay rule of evidence - strike any controversy of material facts.
