Remember, this is not limited to BOA, this is every bank or cu that supplies a credit card or loan. It's called the right of setoff and it applies to any deposit account you have with the same bank or credit union where you have your credit cards and loans. If you fall behind on any payments the bank can take the entire balance you have in your savings and checking accounts (CD's or anyother type of deposit account) and apply it to pay off the debt. The bank does NOT have to bring you to court to do this 'right of setoff' as you agree to it the minute you open a deposit account with the same place you have your loan or credit card.
