I do have one account that is in collection with them, but now they are reporting three instead of one.. This OC verify the made up accounts to EQ, i want to know if I could sue them and how would i go about it...Midland has the only true account and they are reporting it as open and 3 months late.... tigra Posted October 13, 2010 Report Share Posted October 13, 2010 Dispute the items with credit bureaus, it takes about 30 days to get the response. They will verify this information with your creditor, and if it comes back as verified, you got yourself few FCRA violations. Google FCRA for details and exact chapters that apply. I have the results of the investigation. If i wanted to sue First Premier, do i give them the chance to verify the accounts or removed them, or can i just sue them since i have the investigation results. thanks in advance for any help u guys can give.. oldguy47 Posted October 23, 2010 Report Share Posted October 23, 2010 Yes you could just file you case or what I would recommend is sending them a letter (OC) and inform them that you have disputed the accounts and Eq has informed you that they (oc) verified the accounts and that they (OC) have already informed you that the accounts were not yours/correct. I would tell them that if they did not have them removed in 30 day I would sue them (OC).They (OC) will most likely not remove them and if you can I would call and record the call getting one of the “account reps” to confirm they are incorrect. So why go through the extra? Simply put you are showing that you have tried to get them to do the right thing more than once and remove the “we made a mistake” claim. I think that the more documentation (rope to hang themselves with) the better you are in court.The how, go to your local small claims court and they will help you. Thegiver Posted October 23, 2010 Author Report Share Posted October 23, 2010 I have not even call them i was just thinking of making them pay for doing things like this and hopefully deleting the account that i have with them. So by law i have to dispute these bogus account with the OC first. Give them the chance to do the right thing, if they don't comply i can then sue and have a better case. Should i send a DV or just call them...By the way last activity of the only account was 2005 balance of $350. Once again thanks in advance for taking the time to help me with my situation..
