frustratedguyhere01
Hi, I want to vacate a judgment by negotiating a reduced amount. My question is what should I ask for that would benefit my situation in terms of credit. I had asked for the following:1. No filing of 1099-C2. Writ of Execution Returned as Wholly Satisfied They said that they don't know what I'm asking for when requesting these 2 items. Am I requesting the wrong things? What should I ask for that would benefit me the most. Thanks
frustratedguyhere01
I'm sorry, I don't mean vacate judgment as I have already passed that option. I would like to try and minimize the damage from the judgment that is on my credit report.
Recovering Attorney
You would ask them to agree to vacate the judgment then discontinue with prejudice. Then you can get a copy from the court and send it to the CRA as a dispute to the judgment on your credit report. Forget the other stuff. You need to make this plea to the lawyer who took the judgment.
Guest usctrojanalum
Ask for a vacatur of judgment in exchange for a payoff. You are not passed this option yet, a judgment can be vacated at any time. Here in NY it is fairly easy all it really requires is the filing of a few papers and some signatures there is not much too it.

moosie
Trojan, can a vacatur of judgment be filed in CA?I'm not from CA but the law there is that the OC or lawyer must file a satisfaction letter with the court within 30 days of you paying it off.Too bad every state doesn't have such rules on this
609dad
Go to the Rules of Civil Procedure for the state or jurisdiction involved. Read what it says about vacating a judgment. You can probably find the Rules online if you google for them.
