Do I have right to answer this summary. this is not my debt and I have denied it. they say no material facts and that they should win. any help. You said you denied the debt, so I'm assuming you filed an answer to the Complaint?Is the debt in or out of the SOL?What evidence, if any, did they provide?What were your defenses?Read the court rules for your state to see if you can file an Objection to the Motion for Summary Judgment. nobk4me Posted October 15, 2010 Report Share Posted October 15, 2010 Yes, you can respond to their SJ motion. Check Rule 56 of OCRP. Also check the local rules of court for the time within which to respond to the motion. Usually it's 14 days.Be sure to include an affidavit with your response.
